Beautiful World: "The difference between friendship and love is how ...

I have been blogging for years--and this post will be very long.

Anyone (Josh) who has had the stamina to read the bulk of what I've written deserves an award of some sort--I have a feeling the award would be nothing highly sought and if tangible, no doubt it would be disposed of rather quickly or hidden shamefully in some tiny cranny found in the dark recess of a metropolitan sewage system. Regardless, the prize should be awarded because that kind of readership is remarkable. I have written innumerable posts on more than one blog nearly every day for several years.

I mention this because many of my posts have addressed the topic of human relationships and in the process, it has become very clear that I am not a?proponent?of friendship. I've stated my views more than once but for the sake of brevity, I will summarize my dislike of the concept:

I believe friendship is a sham relationship with lends credence to the idea that some relationships are disposable--and easily revived on a whim. It allows us to "get to know" people with the understanding that should life circumstances become too busy, the friend will be eliminated for simplicity's sake. Also, should another, more interesting person come along, the current friendship can be allowed to dissipate and disappear for the purpose of climbing a social ladder, or simply for better entertainment. Friends are allowed to be comforters,?comrades, and?confidantes until such time as one or the other of the previously stated situations arises, at which point they go their separate ways assured that this is acceptable social behavior. Should one of the friends feel hurt by the subsequent absence of their former friend, they're considered clingy, controlling, or a social embarrassment. Clearly they misunderstood the rules of friendship and don't play the game very well. They are to be avoided.


While my assessment of the friend relationship might seem cynical, it is, nonetheless, accurate. I do not buy into the maudlin acclamation that there are some people who can leave one's life for extended periods of time and when they return, the relationship remains intact--"it's as if no time has passed." That's untrue--because time has?passed. Many important, poignant moments have taken place and that friend who just reentered the scene has missed them all. And so the two friends will have lunch, cram as much personal history as possible into ninety minutes, and then depart, satisfied that the friend relationship is once again thriving. They might telephone a few times over the next year until once again, decades of absence reign over the relationship.

And that is true friendship.

A couple of years ago I had this conversation with Therapist:

Therapist: It sounds to me like a control issue.
Sam: It's not.
Therapist: Well, here's how it looks to me: You find someone you care about deeply and you want to keep them.
Sam: Yes.
Therapist: That's kind of controlling.?
Sam: I'll have to take your word for it. I don't?control them.?
Therapist: No, but you become very anxious because you want to. You're afraid of being vulnerable to them. You're certain they'll leave you at some point because that's what you believe friends do.
Sam: Maybe.
Therapist: And so you make believe that the relationships you have with very close friends are something more than friendship.
Sam: I make believe?
Therapist: I think so. If it's not friendship, what is it?
Sam: I don't know. Familial?
Therapist: Sam, you can't choose the people you want in your family.
Sam: Why?
Therapist: Because, first of all, those people have their own families. You're not a part of that unit, and they're not a part of your family unit.
Sam: Okay.
Therapist: So, if not familial, then what?
Sam: I don't know.
Therapist: You can't keep people, Sam.?
Sam: What if they want me to?
Therapist: As a general rule, people don't like being collected.
Sam: So you're telling me that I'm stuck with the family I have--such as it is. I need to make peace with people who rarely contact me, have no interest in my life, and want me around because someone may need to take care of our parents one day?
Therapist: Is that your judgment of how you fit in your family?
Sam: Yes.
Therapist: Well, it makes perfect sense that you would search outside that unit for people who can be a part of your life. Unfortunately, that's not how it works.?
Sam: I know.
Therapist: At some point it might be a good idea to accept that friendships are a vital and important part of life, that forming healthy ones can be rewarding and joyful, and that you've been blessed with some very special friends.
Sam: Who will leave me.
Therapist: At some point their presence in your life may become less frequent, yes.
Sam: Less frequent means they've left.
Therapist: Sam, it's not an all or nothing situation. If they're absent for awhile, they'll be back when they can accommodate social situations with you. You're not forgotten. I'm not sure it's possible to forget about you.
Sam: That's ridiculous.?
Therapist: Which part?
Sam: Anyone is forgettable.
Therapist: I would say that most people do not forget the ones with whom they've had deep, meaningful friendships.
Sam: That's not true. They get busy or bored or whatever, and they forget. They might remember later, but there were still moments when they forgot.
Therapist: That bothers you.
Sam: I think so. I think I would rather never know people than become so boring that they don't think about me anymore.?
Therapist: Why have you spent so much time in the past few years trying to develop healthy friendships?
Sam: I thought I could do it. I thought I could learn the rules, play the game, and let whatever happened, happen. I thought I'd figure it out.?
Therapist: And now?
Sam: I don't want to figure it out. I fell in love with people. I let them know who I really am. I shared some of my life with them. I allowed them to see parts of me that I've hidden for a very long time. I want them to stay.?
Therapist: Sam, a leave of absence doesn't mean they've gone forever.
Sam: I know. Don't you see? I know! My head gets all of this. It understands and it's completely willing to play the friendship game, regardless of what happens. But my heart isn't. It hates every part of this. It's not happy to fall in love with someone who probably doesn't love as deeply, who views me as disposable or convenient, or, worse, thinks I'm some amazing person to look up to--because I'm not, you know, and I've never pretended to be anything more than I am.
Therapist: What do you want, Sam?
Sam: I want them to be in my life forever.
Therapist: And you know they can't?
Sam: Yes.
Therapist: Someday, I believe you'll get to the point where you'll understand that absence does not constitute a lessening of love or affection. It simply means that someone's life became differently shaped and could no longer accommodate frequent contact with you. And you'll be patient, because that's sort of how you work, and you'll allow them to decide if frequency of contact will occur again.?
Sam: I do that now.
Therapist: Yes, but the difference is, when this happens it won't hurt so much.


I didn't record this conversation when it happened because I was embarrassed by it. I didn't like the intimation that I was controlling, and I was keenly aware that I wanted more from people than they were willing to give. I was also rather proud of myself for being aware of those feelings but always being able to manage them. I was not prone to manipulation nor coercion in any of my relationships and those certainly had opportunity to present themselves. I have been guilty on occasion, however, of asking certain of my friends for reassurance that they would remain in my life. Someday I will ask their forgiveness. I'm not ready to do that yet.

The conversation is now appearing because I believe I'm at a point in my life where, while I don't understand how people bond and let go on a regular basis, I do accept it. I don't know that I will ever practice the custom as it commonly occurs, and probably I will always try to "collect" the people I love and I'll want them to stay in my life and I might even feel (if they do?stay) that they are my family; but I will never verbalize those things, nor will I impose my desires upon them. Regardless of whatever emotional deficits with which I may struggle, I am keenly aware of the need to maintain healthy boundaries and balance in any relationship and I wish for those I love to feel safe in relationships with me.

And so today I will begin to have friends. I will embrace the term and use it. I will not be offended nor feel slighted when someone I love refers to me as "friend. One of those loved ones has told me on more than one occasion that I am one of the best friends he has ever had--and he has said that in spite of the fact that presently our life goals and beliefs are different. I choose to believe he made that statement because he knows I don't walk out on relationships that become difficult, I support his right to make decisions for himself, and even if I disagree with the outcome of such decisions I still wish to talk with him and spend time with him. I should feel happy that he believes I am one of his good friends.

Another loved one has referred to me as his best friend on occasion and, when introducing me, once said we are "the best of friends." I believe my response to that was, "Only if I say so." It was churlish, and my way of saying, "You, of all people, understand how deeply I despise that word, and I'm unhappy that you used it in reference to me." And given that I have provided no alternate descriptor, it was out of line for me to object. Because I love him, as well, and have always offered that love without reservation, I should feel honored that he would introduce me in such a way. There is no reason for me to take offense.

There are others who consider me a friend. It's time for me to assume the role they have assigned me.

Therefore, to all my friends, I ask your forgiveness for my boorishness in reference to the laudable institution of friendship. I will stop trying to reshape our friendship into some sort of relationship which has no name. I'll not refer to us during therapy sessions, as "familial." I won't ask you to please stay in my life forever, and I'll no longer balk or remind you that I don't like the F-word and would prefer that it not be used to describe me.

Fake it till you make it, right? I can do this.

This is the eighth post in a series entitled: The Principles of International Negotiation: Finding Universal Value in a Complex World

If you are skillful in building a good negotiation process, your negotiations with your client should never end because you?ll be doing repeat business.

If negotiations are a building block for successful relationships, then they must be seen as a form of interval training, not a single sprint. Since negotiation work can result in a long-term future (or no future), success in that work will create business relationships that make doing business easier and more rewarding for all parties.

Negotiations do not end with the contract signing. In fact, some of the most difficult negotiations may begin after the initial contract is signed. This is particularly true in the technology industry, where many contracts are drawn up before implementation takes place, before any service has been performed, and even before all requirements are known. These types of contracts guarantee that there will be yet more negotiation.

Some of the most difficult negotiations occur in this execution and revision period. Most contracts have an amendment process, evolving statements of work, change control procedures, engineering change mechanisms, or provisions for out-of-scope requests.

Cultural differences toward contracts will further underline the continuous nature of negotiations. The Chinese, for instance, are not as legalistic about contracts as Westerners tend to be. They often consider vagueness in contracts to be acceptable and the terms open to continuous negotiation. This highlights the nature of international negotiations as a continual effort in relationship building that can be as important as any deal terms or value arguments. Another version of the continuous nature of negotiations is that in each negotiation cycle, the parties will call upon what happened before as a model ? sometimes of what they want, and sometimes of what they don?t want. But memory and impressions from earlier concluded negotiations will always be a factor in the next round. Of course, if any sequence of negotiation is a complete failure, there may not be a next round. We often hear, in sessions around the world, a vendor say, ?I?m in the penalty box with my client.? What they really mean is that because of a delivery problem, or a bad negotiation, they are paying the price in their current negotiations. It?s continuous.

Discussions between customers and suppliers should never end, especially if the relationship is good. An end usually means the relationship is over and only the ?survival? terms of the agreement are being implemented.

SIMMONS: Mayor better be on the job for jobs

ANALYSIS/OPINION:

Eric Smith doesn?t ordinarily spend his Saturday mornings anxiously waiting in line to get inside a church.

Yet there he stood over the weekend among hundreds and hundreds of strangers, all of whom were profusely sweating from the midmorning sun and the prospect of a getting a job with one of the nation?s biggest big-box retailers at Costco?s job fair at Mount Horeb Baptist Church in Northeast.

Mayor Vincent C. Gray and Ward 5 D.C. Council member Kenyan McDuffie worked the line, which snaked around the corner onto Bladensburg Road and grew longer and shorter as applicants entered the church after descending from Metrobuses, cars and vans and arriving on foot.

The job fair was so successful that another is being planned for September ? and I have the mayor on record promising to follow through.

Many of the job applicants Saturday were newly minted senior citizens, those old enough to get an AARP card at age 50, but scores of others were barely old enough to buy alcohol.

They all were hoping and praying, telling the mayor and other organizers of their unemployment dilemmas, the kind that do not show up in the monthly labor reports.

Mr. Smith was one such job seeker.

He knows word from Costco might not come this week or next, and he knows it?s because of what continues to place him between a rock and a very hard place.

?I?m an ex-offender, but it?s not who I am,? said Mr. Smith, who ordinarily would have been at a program with other offenders. ?It?s what I served time for.?

What he did was shoot another human being in 1990, violating one of God?s commandments and man?s law.

Does he regret what happened? He said he does.

Is he trying to walk the straight and narrow? He said he is.

But Mr. Smith, a 41-year-old Washington native, is more than a returning citizen in search of steady employment in a city and nation where joblessness is as much of a measure of a man as local and national politics.

As a husband, father of disabled kids and grandfather, he said he keeps his eyes focused on what could be, like his son Angelo.

Police arrest 29 for ticket scalping

LONDON (Reuters) - London's Metropolitan Police said on Monday they had arrested 29 people since the start of the Games for illegal reselling of Olympics tickets.

Of the 29 held, 11 have been charged.

"Ticket touting is illegal and is a clear exploitation of those who genuinely wish to experience the Games first-hand," said the officer in charge of a crackdown on illegal ticket resellers, known in Britain as touts and in the United States as scalpers.

"We have been, and will continue to, seek out and take robust action against anybody who tries to cash in on the 2012 Games in this way," Detective Superintendent Nick Downing said in a statement over the weekend.

Many Britons have been frustrated by their inability to buy tickets for the Games, and exasperated at television images of rows of empty seats at some venues.

But police warned against buying from touts.

"If you do, you are likely to find yourself paying over the odds for them, while at the same time fuelling criminality," Downing said.

In Israel, Romney declares Jerusalem to be capital, takes aggressive stand against Iran

JERUSALEM - Standing on Israeli soil, U.S. presidential candidate Mitt Romney on Sunday declared Jerusalem to be the capital of the Jewish state and said the United States has "a solemn duty and a moral imperative" to block Iran from achieving nuclear weapons capability.

"Make no mistake, the ayatollahs in Iran are testing our moral defenses. They want to know who will object and who will look the other way," he said. "We will not look away nor will our country ever look away from our passion and commitment to Israel."

The presidential election hovered over the speech. The Old City formed a made-for-television backdrop behind Romney, while some of his campaign donors listened in the audience.

Romney's declaration that Jerusalem is Israel's capital was matter-of-fact and in keeping with claims made by Israeli governments for decades, even though the United States, like other nations, maintains its embassy in Tel Aviv.

He did not say if he would order the embassy moved if he wins the White House, but strongly suggested so in a CNN interview.

"My understanding is the policy of our nation has been a desire to move our embassy ultimately to the capital (Jerusalem)," he said, adding, "I would only want to do so and to select the timing in accordance with the government of Israel."

His remarks on the subject during his speech drew a standing ovation from his audience, which included Sheldon Adelson, the American businessman who has said he will donate millions to help elect Romney to the White House.

Romney's embrace of Israel was on display earlier in the day when he met with Prime Minister Benyamin Netanyahu and other leaders. He also visited the Western Wall, Judaism's holiest site, where he was mobbed by worshippers. In addition, Romney met with Palestinian Prime Minister Salam Fayyad.

In his remarks, Romney steered clear of overt criticism of President Barack Obama, even though he said the threat of a nuclear-armed Iran "has only become worse" in the past five years.

In an unspoken rebuttal to Obama and other critics, Romney said, "It is sometimes said that those who are the most committed to stopping the Iranian regime from security nuclear weapons are reckless and provocative and inviting war.

"The opposite is true. We are the true peacemakers," he said.

The former Massachusetts governor also stepped back from a comment a senior aide made a short while before the speech.

"We recognize Israel's right to defend itself," he told the audience. Earlier, the aide, Dan Senor, previewed the speech for reporters, saying that "if Israel has to take action on its own, in order to stop Iran from developing the capability, the governor would respect that decision."

Israel is the second of three stops on an international trip for Romney in the weeks before he claims the Republican nomination at his party's national convention in Tampa, Fla.

He flew to the Middle East from Britain, where he caused a stir by questioning whether officials there were fully prepared for the Olympic Games. A stop in Poland will complete his trip.

Four years ago, then-U.S. Sen. Barack Obama also visited Israel as a candidate, part of a five-nation trip meant to establish his own foreign policy credentials.

In his speech, Romney said Syrian President Bashar Assad "desperately clings to power" in Damascus in the face of an attempted overthrow, but he did not call for his removal.

He noted that Egypt is now headed by an "Islamist president, chosen in a Democratic election. ... The international community must use its considerable influence to insure that the new government honors the peace agreement with Israel that was signed by the government of Anwar Sadat" more than three decades ago, he said.

A goal of Romney's overseas trip is to demonstrate his confidence on the world stage, but his stop in Israel also was designed to appeal to evangelical voters at home and to cut into Obama's support among Jewish voters and donors. A Gallup survey of Jewish voters released Friday showed Obama with a 68-25 edge over Romney.

Romney and other Republicans have said Obama is insufficiently supportive of Israel, noting statements the president has made about settlements and his handling of evident Iranian attempt to develop nuclear weapons.

Tehran is closer to developing nuclear weapons capability than before, Romney said. "Preventing that outcome must be our highest national security priority."

In a March speech before a pro-Israel lobby in Washington, Obama warned of "loose talk of war" that serves only to drive up oil prices. "Now is not the time to bluster," he said then. "Now is the time to let our increased pressure sink in and sustain the broad international coalition we have built."

It was unlikely that the day's events would settle the issue.

Senor's comments caused a stir in the hours leading to Romney's speech, a reminder of the controversy that Romney had created a few days earlier in London.

He later clarified his comments in a written statement, saying that the candidate "believes we should employ any and all measures to dissuade the Iranian regime from its nuclear course and it is his fervent hope that diplomatic and economic measures will do so. In the final analysis, of course, no option should be excluded."

Pentagon officials have spoken publicly about the difficulty of such a strike and American officials have expressed concern about the destabilizing effect such military action could have in the region, even if carried out successfully.

Bells peal across Britain as Games get under way

LONDON (Reuters) - Bells rang out across Britain on Friday to signal the final countdown to the Olympic Games, which open with an exuberant and eccentric ceremony celebrating the nation in an explosion of dance, music and fireworks inspired by Shakespeare's "Tempest".

The three-hour showcase created by Oscar-winning "Slumdog Millionaire" director Danny Boyle takes spectators on a journey from Britain's idyllic countryside through the grime of the Industrial Revolution and ending in an explosion of pop culture.

Watched by 60,000 people at the main Olympic stadium built in a run-down part of east London and a global audience of more than a billion, the event will have passages described by British Prime Minister David Cameron as "spine-tingling".

The spectators will be urged to join in sing-a-longs and help create spectacular visual scenes at an event that sets the tone for the sporting extravaganza, when 16,000 athletes from 204 countries share the thrill of victory and despair of defeat with 11 million visitors.

The Games will also answer the question on Britons' lips -- were seven years of planning, construction and disruptions, and a price tag of $14 billion during one of the country's worst recessions, actually worth it?

"There is a huge sense of excitement and anticipation because Britain is ready to welcome the greatest show on Earth," said Cameron. "This is a great moment for our country so we must seize it."

There have, however, been bumps along the way.

Media coverage was until recently dominated by security firm G4S's admission that it could not provide enough guards for Olympic venues. Thousands of extra soldiers had to be deployed at the last minute, despite the company's multi-million-dollar contract from the government.

Counter-terrorism chiefs have played down fears of a major attack on the Games, and Cameron said that a safe and secure Olympics was his priority.

"This is the biggest security operation in our peacetime history, bar none, and we are leaving nothing to chance."

Suicide attacks on London in July, 2005, killed 52 people. This year the Games coincide with the 40th anniversary of the 1972 Munich massacre when 11 Israeli Olympic team members were killed by Palestinian militants.

Calls for an official commemoration of the tragedy at the opening ceremony have so far been refused.

Heavy traffic in central London and severe delays on Britain's creaking train system have added to the grumbling.

A series of doping scandals have tarnished the Games' image in the build-up, with at least 11 athletes banned so far, and Greek triple jumper Paraskevi Papachristou became the Olympics' first "twitter victim" when she was withdrawn from the team over tweeted comments deemed racist.

An early diplomatic faux pas, when the flag of South Korea appeared at a women's soccer match between North Korea and Colombia, prompted fuming North Korean players to walk off the pitch and delayed kick-off by more than an hour.

All of that is likely to be forgotten as attention around the globe turns to the opening ceremony, which begins at 2000 GMT and ends more than three hours later.

While Boyle has urged the 10,000 participating volunteers and large crowds at rehearsals this week to keep the show a secret, some elements are already in the public domain.

Titled "Isles of Wonder", it opens with a recreation of bucolic bliss, complete with fields, hedges, sheep, geese, a shire horse, shepherdesses and even a game of village cricket.

The mood then darkens as "England's green and pleasant land", from a poem by William Blake, makes way for the sooty chimneys and smoking steel works of the "dark Satanic Mills", evoking the 19th century urban settings of Dickens.

Stirring music from Britain's past and present provides the soundtrack, which comes to the fore in the latter stages with a psychedelic celebration of pop culture including songs, sitcoms and cinema classics.

Cyclists with illuminated "wings" circle the arena, creating a stunning effect for cameras suspended from the stadium roof.

Boyle's ode to the National Health Service, a politically charged topic in Britain where people are emotionally tied to the ideal of a welfare state, may make less sense to people watching from afar.

But a closing performance by ex-Beatle Paul McCartney should have global appeal for a ceremony that will contrast sharply with Beijing's tightly choreographed, large-scale version.

Boyle had 27 million pounds ($42 million) to spend on his spectacular, well under half the amount estimated to have been spent in China in 2008.

There are still plenty of secrets, including who will have the honour of lighting the Olympic cauldron, the moment symbolising the opening of the Games and ending the Olympic torch's 8,000-mile journey the length and breadth of Britain.

On Friday, the torch made its way up the River Thames aboard the royal barge Gloriana, which was used in Queen Elizabeth's Diamond Jubilee in June.

The 86-year-old monarch will be in the crowd, along with U.S. First Lady Michelle Obama and a host of dignitaries and celebrities.

BOLT OR BLAKE?

The first main day of sport is Saturday, when Briton Mark Cavendish is favourite to win gold in the road race in what would be the perfect start for the home nation, and would come hot on the heels of Bradley Wiggins' win at the Tour de France.

Britain's hopes are high overall after a successful Games in Beijing, although the United States, China and Russia could dominate the medals table yet again.

The highlight of the Games is the men's 100 metres final, traditionally the blue riband event of the Games, with Jamaican Usain Bolt's domination of the discipline under threat from training partner and compatriot Yohan Blake.

Bolt, fastest man on earth, is vying to do what no man has done before -- successfully defend the 100m and 200m Olympic titles, and, despite fitness concerns, he is talking tough.

"For me, it is all about the win," he told Reuters in an interview. "I am not really worried about a world record now. "And I am going out there (to) get it done."

If Bolt and Blake make the final, the August 5 race will rival the Carl Lewis-Ben Johnson clash at the 1988 Seoul Olympics for drama and excitement.

U.S. swimmer Michael Phelps will also be looking to cement his place as the world's greatest swimmer by adding to the eight gold medals he won in Beijing.

You?d be surprised.

Following a release in Britain a few months ago, "The Poetry of the Taliban"?has been released this week in the United States, published by Columbia University Press.

I will let the literary set decide what is good poetry or bad poetry, although the estimable New-Delhi-based British historian William Dalrymple did have this to say:

?This extraordinary collection is remarkable as a literary project ? uncovering a seam of war poetry few will know ever existed, and presenting to us for the first time the black turbaned Wilfred Owens of Wardak. But it is also an important political project: humanizing and giving voice to the aspirations, aesthetics, emotions, and dreams of the fighters of a much-caricatured and still little-understood resistance movement that is about to defeat yet another foreign occupation.?

For those who have spent any length of time at all in Afghanistan, it will come as no surprise that Afghans are a poetic people.

As a young war correspondent in Jalalabad, one of my keenest memories was not a night of bullets flying and prayers spoken, but rather a night of poetry. We had just eaten a meal of rice and lamb, and my host and his cousins and friends were passing around a watering can to wash their hands.

And then it began: One gentleman among us recited a love poem of startling romantic sincerity. Then came another poem about the feebleness of human character. Then another about a fickle lover. Then another about the terrors of battle, and the loss of a loved one. Some of these poems were ancient, but most had been written by the men who were reciting them, all doctors and merchants and political science students. And there wasn?t a cheap and dirty limerick in the lot.

My hosts turned to me, and I had nothing to offer, except appreciation for the beauty of their words.

Today, the release of this Taliban poetry book is an odd echo of that evening session. Odd, because I had probably assumed that poetry only occurred among the semi-elite, and especially those of the enlightened democratic sort who would have been fighting against the Taliban. But poetry is a potent weapon that only gets stronger in the hands of someone faced with an impossible cause and a powerful enemy.

One doesn?t have to agree with the Taliban worldview to appreciate the haunting power of this poem, written in 2007 by Taliban poet Shahzeb Faqir:

This case charges, accurately, I believe, that Bianchi and his staff members who were criminally charged were ?victims of politically and financially motivated criminal investigations and prosecutions,? as the court documents charge, ??the product of a conspiracy, initiated by Bianchi?s political enemies, to remove Bianchi from office.?

Naturally, the language used in the case reflects most favorably upon the Bianchi side of the fight.

With the $157,500 settlement by Special Prosecutor Henry Tonigan in the suit brought by McHenry County State?s Attorney Lou Bianahi and his employees, it seems to me that the court filing by his attorney Terry Ekl deserves to be easily found.

I have the feeling that the document will be referenced more than once in the coming months.? That?s the nature of the beast.

In the terms of the media, this story ?has legs.?

INTRODUCTION

This action is brought pursuant to the First, Fourth and Fourteenth Amendments to the United States Constitution and under Illinois State Law. Plaintiff Louis A. Bianchi, the State?s Attorney of McHenry County (hereinafter ?Bianchi?), and three of his employees were the victims of politically and financially motivated criminal investigations and prosecutions orchestrated by Defendants Henry C. Tonigan, III and Thomas K. McQueen, in their roles as taxpayer funded special state?s attorneys in McHenry County, in concert with their co-Defendant private investigators, acting as special state?s attorney investigators.

The investigations and prosecutions were the product of a conspiracy, initiated by Bianchi?s political enemies, to remove Bianchi from office by fabricating false criminal charges and prosecuting Bianchi and his employees for criminal offenses, despite the lack of probable cause or credible evidence to support such charges.

To accomplish this goal, Defendants manufactured and fabricated

  • false evidence,
  • concealed exculpatory evidence,
  • presented perjured testimony to a grand jury, and
  • engaged in gross investigative and prosecutorial misconduct.

As a result, Defendants obtained two highly publicized criminal indictments against Bianchi and a criminal indictment against three of his employees, Plaintiffs Joyce Synek, Ronald Salgado, and Michael McCleary, all of which were wholly unsupported by probable cause or credible evidence.

The conspiracy crumbled when Bianchi resisted pressure to resign from office and instead proceeded to trial where he and Plaintiff Synek were acquitted of all charges by a directed finding, and where the charges against Plaintiffs Salgado and McCleary were dismissed by the trial court.

Despite Defendants? failure to force Bianchi from office, Plaintiffs suffered significant severe and permanent damages based on the constitutional and state law violations that resulted from Plaintiffs? unlawful arrests, indictments, and prosecutions.

JURISDICTION AND VENUE

1. This Court has original jurisdiction over this matter pursuant to 28 U.S.C. ? 1331 and ?1343(a)(3), as the federal claims are brought under 42 U.S.C. ?1983. Venue is proper pursuant to 28 U.S.C. ?1391(b), as all or some of the parties reside in the Northern District of Illinois and the events giving rise to the claims occurred in this district. The Court has supplemental jurisdiction over Plaintiffs? state law claims pursuant to 28 U.S.C. ?1367(a).

2. The Plaintiff, Louis A. Bianchi, is a resident of the Northern District of Illinois. At all times relevant, Bianchi has been the elected State?s Attorney of McHenry County. Bianchi brings this action in his capacity as a private citizen.

3. The Plaintiff, Joyce A. Synek, is a resident of the Northern District of Illinois. At all times relevant she was employed as an Executive Administrative Assistant to Bianchi.

4. The Plaintiffs, Ronald J. Salgado and Michael J. McCleary, are residents of the Northern District of Illinois. At all times relevant, they were employed as investigators for the McHenry County State?s Attorney?s Office (hereinafter ?SAO?).

5. The Defendants, Henry C. Tonigan, III and Thomas K. McQueen are residents of the Northern District of Illinois.

At all relevant times they were attorneys, appointed as a taxpayer funded McHenry County special state?s attorney and an assistant to the special state?s attorney, respectively, and were acting under the color of law and with the same power and authority as a duly elected state?s attorney with respect to matters committed to their discretion.

This action is brought against Tonigan and McQueen in their individual capacities.

6. The Defendant, Kelleher & Buckley, LLC, at all relevant times was an Illinois limited liability company doing business as a law firm in the Northern District of Illinois. At all relevant times, Tonigan was employed as an attorney by Kelleher & Buckley and was acting within the scope of his employment and/or agency.

7. The Defendant, Quest Consultants International, Limited (hereinafter ?Quest?), at all relevant times was an Illinois corporation doing business in the Northern District of Illinois. At all relevant times, Quest and its employees were retained by Tonigan and McQueen as taxpayer funded special investigators to the special state?s attorney. As such, Quest and its employees acted under the color of law and with the authority and power to exercise police powers and conduct criminal investigations.

8. The Defendants, Robert Scigalski, Daniel Jerger, James Reilly, Patrick Hanretty, and Richard Stilling, at all relevant times were employees of Quest, retained by Tongian and McQueen as taxpayer funded special investigators to the special state?s attorney, and appointed by the Circuit Court of McHenry County as agents and investigators of the special grand jury. As such, these Defendants acted under the color of law, with the authority and power of peace officers, and within the scope of their employment with Quest.

FACTS COMMON TO ALL COUNTS OF THE COMPLAINT
BACKGROUND OF THE CONSPIRACY TO REMOVE BIANCHI FROM OFFICE

9. In November of 2004, Plaintiff Bianchi was elected State?s Attorney of McHenry County after having previously defeated Glenn Gable in the March 2004 Republican primary.

10. Upon taking office on December 2, 2004, Bianchi promptly began reforming the SAO by inter alia:

(a) Eliminating the abuse of plea bargaining with politically connected defense attorneys;

(b) Increasing the amount of hours that all SAO employees were required to work each day;

(c) Refusing to give special deals to

  • political operatives,
  • contributors, and
  • friends of the previous administration; and

(d) Terminating the employment of SAO employees who were unqualified or unwilling to competently perform their assignments.

11. As a result of these reforms, Bianchi frustrated political operatives in McHenry County who had obtained more favorable accommodations with the previous administration and other McHenry County departments.

12. In March of 2007, Bianchi announced his intention to run for re-election in the November 2008 State?s Attorney?s election.

13. Bianchi was opposed in the February 2008 Republican primary by Daniel Regna, a former assistant state?s attorney (ASA) under the previous administration, whom Bianchi had refused to hire.

14. The 2008 Republican primary campaign between Bianchi and Regna was highly contentious, and sharply divided supporters of Bianchi?s reforms and the political operatives who supported Regna in an effort to return the SAO to its prior mode of operation.

15. Bianchi won the February 2008 primary against Regna, prevailed again in the November general election, and in December of 2008, began his second term as State?s Attorney of McHenry County.

16. After failing in their efforts to legally remove Bianchi from office during the 2008 election, Bianchi?s political opponents initiated a politically motivated conspiracy to override the election and force Bianchi from office. The objective of this conspiracy was to

  • arrest,
  • indict, and
  • publicly smear Bianchi,

thereby causing him to resign his office, irreparably tarnish his public reputation, and allow his political opponents to install a State?s Attorney who would do their bidding.

The Manipulation of Amy Dalby and
the Appointment of a Special Prosecutor by Bianchi?s Political Enemies

Although Dan Regna filed a motion asking for the appointment of a Special Prosecutor, it was one filed on behalf of Amy Dalby which set into motion the chain of events outlined in this court filing.

17. From June 2004 until she resigned in July of 2006, Amy Dalby was employed as a secretary in the SAO.

18. Prior to resigning, Dalby stole approximately 5000 documents from a SAO computer, including confidential and sensitive documents concerning pending investigations and prosecutions.

19. Dalby stole the documents from the SAO at the suggestion of Kristen Foley, an ASA whom Bianchi had demoted from her position as Chief of the Civil Division. In the summer of 2007, Foley began actively working on the political campaign of Bianchi?s 2008 primary opponent, Daniel Regna.

20. In October 2007, Dalby gave the stolen documents to Kristen Foley for use in Regna?s campaign. Foley then disclosed the stolen documents to the media.

21. In November of 2007, Bianchi learned of the theft and petitioned a court to appoint a special prosecutor, independent of the SAO, to investigate, and if necessary, prosecute the responsible individual.

22. In March of 2009, Dalby was arrested and charged with six felony offenses. On or about June 1, 2009, Ms. Dalby pled guilty to computer tampering.

23. In the meantime, on February 23, 2009, in the Circuit Court of McHenry County, Daniel Regna filed a politically motivated petition to appoint a special prosecutor to investigate Bianchi, alleging that Dalby performed political work while working in the SAO.

24. Likewise, on April 23, 2009, at the direction and/or with the assistance of Bianchi?s political enemies, Dalby herself filed a petition for appointment of a special prosecutor to investigate her allegation that she performed political work while working in the SAO from December of 2004 until July of 2006.

25. The three year statute of limitation on any allegations made in Amy Dalby?s petition expired no later than July 2009, three years after Dalby left the SAO.

Nonetheless, on September 4, 2009, McHenry County Circuit Court Judge Gordon Graham granted Dalby?s petition to appoint a special prosecutor.

26. Judge Graham also granted McHenry County?s Petition to Intervene and allowed the State?s Attorney?s Appellate Prosecutor?s Office to represent the interests of McHenry County in the matter.

27. On September 18, 2009, Judge Graham appointed Defendant Tonigan as a special state?s attorney and appointed Defendant McQueen to ?assist? Tonigan.

28. Judge Graham?s order limited Defendants Tonigan and McQueen?s authority to investigating and/or prosecuting Dalby?s allegation that she performed political work at the SAO from December 2004 until July 2006.

29. The court file in the case appointing Defendants Tonigan and McQueen was later sealed and McHenry County, despite having an appearance on file, was not served with notice of a motion to seal the file and was not heard on the matter.

30. Furthermore, Defendants Tonigan and McQueen convinced Judge Graham, in an ex parte fashion, and without any input from McHenry County or its attorney, to compensate each of them at a rate of $250 an hour. This agreement violated 55 ILCS 5/3-9008, which, in order to avoid abuses of the public fisc, prohibits special state?s attorneys from exceeding the compensation of the elected state?s attorney, in a given year.

31. In October of 2009, Defendants Tonigan and McQueen interviewed Dalby and learned, by that time, at the very latest, that the statute of limitations barred any prosecution of Bianchi, or anyone else, for the allegations made by Dalby, even if true.

October-November 2009: Tonigan and McQueen Illegally Expand Their Investigation

32. Despite having a legal obligation to do so, Defendants Tonigan and McQueen did not terminate their investigation in October of 2009. Instead, Defendants Tonigan and McQueen unilaterally began an illegal taxpayer funded investigation into Bianchi and the SAO that grossly exceeded their limited legal authority. Defendants Tonigan and McQueen?s illegal investigation included misrepresenting themselves as special state?s attorneys and interviewing individuals regarding matters that far exceeded the scope of their limited appointment.

33. In order to continue the illegal investigation of Bianchi, fabricate a timely charge, an continue billing McHenry County exorbitant fees, in November of 2009, Defendants Tonigan and McQueen sought to expand their investigative authority. In order to conceal their conduct and prevent a challenge to the unwarranted expansion, Defendants Tonigan and McQueen decided not to properly petition the court, as required by Illinois law.

34. Instead, on November 18, 2009, Defendant Tonigan wrote Judge Graham an ex parte letter which, in violation of the Rules of Professional Conduct, was not sent to the County or its attorney, who had an appearance on file in the case. Tonigan?s letter was written on the letterhead of his employer, Defendant Kelleher & Buckley.

35. In the letter, Defendant Tonigan claimed that he and Defendant McQueen had already interviewed a number of witnesses and based on those interviews asked Judge Graham to ?expand the order defining the role of our investigation.?

36. In order to expand his authority and persuade Judge Graham that Bianchi should be investigated for crimes that were not time-barred, Defendant Tonigan?s letter contained the following blatantly false statements regarding Bianchi:

  1. Dalby stated that she trained her successor [Joyce Synek], to perform political work on County time;
  2. There is a likelihood Synek provided secretarial services for Bianchi?s political interests on County time at least until September or October of 2007;
  3. Witnesses provided information about possible illegal acts by Bianchi related to his misuse or theft of County funds; and
  4. A witness indicated that Bianchi utilized County vehicles for his personal and political use.

37. Based upon those false representations, on January 7, 2010, Judge Graham signed an order, provided by Defendant Tonigan, granting Defendants Tonigan and McQueen the authority to investigate and prosecute Bianchi and ?any and all persons? relative to any misappropriation or theft from ?2005 and thereafter.?

December 2009-May 2010 Investigation: The Special Prosecutors and Quest Investigators Collaborate to Fabricate Evidence

38. Around December of 2009, the Defendant law firm of Kelleher & Buckley, acting through its agent Defendant Tonigan, retained an investigative firm, Defendant Quest, to investigate Bianchi.

A billing arrangement was determined and agreed to, on an ex parte basis, by Defendant Tonigan, Defendant Quest, and Judge Graham, without any participation by McHenry County, the entity that was ordered to pay Defendant Quest?s bills.

It was determined that each of Defendant Quest?s employees would be billed at an exorbitant rate for police investigators of $135 an hour, an hour.

39. After being appointed as special investigators, Quest employees, including, but not limited to, Defendants

  • Jerger,
  • Scigalski,
  • Reilly,
  • Hanretty, and
  • Stilling

(hereinafter collectively referred to as ?Quest Investigators?) participated, with Defendants Tonigan and/or McQueen, in a wide ranging politically and financially motivated investigation of Bianchi and the SAO.

40. Defendants Tonigan and/or McQueen, along with Defendant Quest investigators, and other as yet unnamed co-conspirators, met and agreed, through explicit and/or implicit means, to manufacture and fabricate evidence for the purpose of removing Bianchi from office by charging and prosecuting Bianchi and other SAO employees for criminal offenses, despite the lack of probable cause or credible evidence.

41. In furtherance of that agreement, Defendants Tonigan and/or McQueen interviewed individuals for the purpose of obtaining rumor and hearsay information to support their predetermined decision to prosecute Bianchi and remove him from office.

42. Defendants Tonigan and/or McQueen also directed the Defendant Quest Investigators to conduct certain interviews for the purpose of manufacturing and fabricating evidence.

43. The Defendant Quest Investigators represented themselves to witnesses as McHenry County Special Investigators who had been engaged by Defendant Tonigan to conduct an investigation into the official misconduct in the SAO.

44. After conducting interviews, the Defendant Quest Investigators informed Defendants Tonigan and/or McQueen of information related during the interviews.

Dar es Salaam. Participating at last year?s Top 100 mid-sized survey has brought Mitsumi Computer Garage and Simply Computers many benefits, but the increased imports of counterfeit information technology hardware is one of the challenges they face in their businesses.

The benefits the two firms got since becoming one of the winners of the Top 100 survey include increased sales due to customers recognition as well as improved accounting and financial reporting standards.

The survey has also increased chances of access to finance. Top 100 mid-sized company survey is organised by KPMG Tanzania and The Citizen.

The general manager of Mitsumi Computer Garage Ltd Mr Kartik Shah says the local market ratio is currently 60:40 for fake and genuine ICT products both in software and hardware.

?There is much need to educate people about the two types of products in order to increase efficiency and develop the local market,? says Mr Shah who is information technology expert.

To avoid including the counterfeit computers in their stock, Mitsumi deals with major brands only like Toshiba, Dell, HP, Acer and Microsoft software only.

Government austerity measures, which have resulted in reduced spending in IT hardware and related accessories has also impacted the business because the state is the biggest customer on IT products.

The general manager of Simply Computers Mr Rizwan Jaffer says there is a decrease in procurement from the government, a situation the company and other ICT firms started to experience after the 50th anniversary.

According to Mr Jaffer, the situation continues to worsen as the national census approaches. ?We suspect that the government spent a lot of money to celebrate Tanzania?s fiftieth anniversary and now is expecting to spend again in the coming census in August.

If this is true, I don?t know what will happen in 2015 general election,? says Mr Jaffer.

Although the company sells in retail, it also serves corporate companies like banks, insurance firms and public institutions in both Tanzania Mainland and Zanzibar.

?With the exception of the government case, the market is generally good and we don?t have any plan so far to expand outside the country. We have agents in almost all regions that ensure that our customers receive genuine brands,? Mr Jaffer says.

To help Top 100 survey companies to overcome such kind of difficulties the organisers of the survey have launched the Top 100 Mid-Sized Companies Club 2011 forum, which would be a platform for networking and sharing information. Top 100 survey companies would also get an opportunity to meet policy makers.

Simply Computers which is a direct partner to Dell, sells both laptops and desktop computers and other ICT equipment. As far as other winners are concerned, Simply Computers also confirms increasing service confidence from their clients after the Top 100 award last year.

?Our company is generally doing well as we maintain our existing customers and increase new ones. Top 100 Mid-sized Survey is a commendable job because it exposed us to clients and even connects us to various organisations,? says Mr Jaffer.

One of the objectives of the survey include creating industry databases and that would enable medium-sized companies to benchmark themselves against their peers as well as highlighting, to policymakers, their contribution to economic growth.

It deals with distribution of various global IT hardware and software brands. It operates in 12 countries and there are plans to expand more.

Mr Shah commends the Top 100 survey in the country but advises to go sector-wise after getting to full list of 100 best companies.

?After having a list of 100 winners and the overall winner, the organisers can put us sector-wise so that we can understand who is leading in which sector. It?s good to challenge ourselves that way,? he says.

The company also shares the sentiment that transactions of ICT facilities with the government are still slow citing reports that the government has no money currently as it approaches the census this August

Top 100 Mid-sized Company survey is the first ever of its kind in the country to showcase business excellence. KPMG Tanzania and The Citizen launched recently the second round of the survey in Tanzania.

(AP) ? Former U.S. congresswoman Gabrielle Giffords toured the European particle physics laboratory Wednesday, cheerfully facing reporters but saying little during her first trip abroad since being shot in the head last year.

Giffords was accompanying her husband, retired astronaut Mark Kelly, on a visit to the European Center for Nuclear Research, two days after she rode a cable car up into the French Alps. The lab, known as CERN, had assembled a $2 billion cosmic ray detector that Kelly and his team carried to the International Space Station in May 2011.

That mission came just months after Giffords, a lawmaker from Arizona, was shot by a gunman in a Jan. 8, 2011, rampage that killed six and wounded 13 outside a Tucson supermarket. Since then, Giffords has undergone intensive therapy and made dramatic progress, but she also decided to leave her seat in Congress to focus on her recovery.

During a press conference Wednesday, Kelly joined CERN officials and four other astronauts in recalling the delicate task of installing the 7-ton Alpha Magnetic Spectrometer on the space station so that it can scan the universe for signs of dark matter and antimatter. Kelly commanded the mission, which was the final flight of Space Shuttle Endeavour.

Nobel Laureate Samuel Ting, a physicist at the Massachusetts Institute of Technology and the principal investigator for the CERN-based project, said the detector is functioning "perfectly" and an international team of 600 scientists has now collected data from 18 billion cosmic rays.

Giffords, a Democrat, served on the House Science and Technology Committee, and took on NASA affairs while heading the space subcommittee. Ting singled her out for praise because of her support for the U.S. space program.

"Thank you," she quickly replied, beaming.

The 42-year-old former lawmaker said nothing else publicly, but sat during most of the half-hour press conference with her left hand clasping the hand of Ting's wife, Susan, a psychologist who is assisting her husband's project outside Geneva and who said she found Giffords to be caring and sweet.

Quiet but alert, Giffords walked slowly, with the help of aides, and was dressed casually in sneakers and slacks with her right hand in a brace and her right arm in a sling. The bullet wound in the left side of her brain has affected the use of her right arm and leg.

On Monday, Giffords and Kelly rode a cable car up the Aiguille du Midi outside Chamonix, France, where Kelly and other astronauts installed a plaque on the Refuge des Cosmiques, a high-altitude French lab for studying cosmic rays. She also ventured a few meters onto the snow, accompanied by Kelly and a mountain guide, for a photo op.

During the press conference, Kelly touched on the months between the shooting and the space mission. "As a family, we had a very difficult time between January 2011 up until I came back from space, on June 1. It was quite a challenge," he said.

He turned to acknowledge his daughters Claire and Claudia, and explained that the space shuttle had a little-known rearview mirror in which he could see the rooftop from where they and his wife were watching his launch ? two days before Giffords underwent surgery to repair her skull.

"That was very helpful, just to know they were there supporting me, especially after such a difficult time in our lives," he said.

Kelly said his wife would not grant interviews until sometime later in Arizona. "She's doing great, she's doing great," Kelly told The Associated Press. "She's just here to support me."

Kelly also declined to comment on the Aurora, Colorado, movie massacre last Friday that killed 12 and wounded dozens of others. But soon after the killings he tweeted: "Gabby and I were horrified to hear of the tragedy in Colorado last night. Our thoughts and prayers are with the victims and their families."

Jared Loughner, a college dropout, was charged with first-degree murder in the attempted assassination of Giffords and other alleged crimes stemming from the shooting. He pleaded not guilty and was found mentally unfit to stand trial.

Democrat Ron Barber, Giffords' former aide who also was injured in the shooting that nearly took her life, won a June 12 special election to replace her in the U.S. House of Representatives, a victory she celebrated by hugging and kissing him on his forehead.
