Apps for apes: Orang-utans want iPads for Christmas

Forget bananas. The biggest hit in zoos this year is an Apple, though orangs have more of a geek streak than gorillas

IT STARTED as a joke. On 1 April 2011, British newspaper The Sun ran a story claiming that an experiment to entertain captive gorillas using iPads had left them crazy for the game Angry Birds. "Planet of the Apps", as the April fool's story was headlined, quickly found its way to Scott Engel, a freelance photographer and volunteer at Milwaukee County Zoo in Wisconsin. Engel knew his 3-year-old niece loved using a finger-painting app, so why not a great ape? He had just bought a new iPad, and hearing the zoo's gorilla keeper was looking for ways to keep his charges entertained, Engel offered the zoo his old one.

It turned out that Milwaukee's gorillas lack the geek streak. Direct eye contact is a threat gesture, so faces on the gadget's screen may put them off, Engel suggests. However, the zoo's orang-utans went bananas for Apple's tablet and soon Engel had rustled up three more iPads to keep the apes busy.

Mahal, a 4-year-old male, and his 31-year-old adoptive mother MJ were fascinated from the start. The first time Mahal saw his own image on the screen - taken with the iPad's camera - he threw up his hands and clapped. A shy male named Tommy took a while to warm to his tablet, says Engel, "but now he's really into it".

Then Richard Zimmerman of Orangutan Outreach, a conservation group based in New York, heard about the experiment. He saw its potential for both entertaining apes and studying their behaviour. With a shrewd eye for publicity, he also spotted its value for raising public awareness of the precarious status of orang-utans in the wild. And then there were the networking opportunities - for the apes, that is. Put iPads in zoos across the US and they could be connected through the internet, using Apesbook perhaps, to offer bored orang-utans online "primate play dates". To help raise funds, Orangutan Outreach launched its Apps for Apes campaign in May.

Orang-utans are the obvious candidates for this kind of activity, says Trish Khan, Milwaukee zoo's head orang-utan keeper. These apes are known for their intelligence, curiosity and creativity (they're notorious escape artists, Khan says) but can quickly become bored and depressed in the monotonous confines of captivity. "Their world is really very small," she says, and that makes a computer a welcome distraction.

Khan's orang-utans aren't the first computer-gaming apes. Orang-utans at Atlanta's zoo have been using a concrete "tree" with an embedded touchscreen computer since 2008. The apes use it to play games in which they categorise, match and sequence images, which provides useful data on how orang-utans learn and think.

However the real IT crowd resides at the Smithsonian National Zoo in Washington DC. Since 1994 its orang-utans have used computers both for entertainment and to communicate with keepers using a simple symbol-based language. Currently their "dictionary" contains around 70 symbols including nouns such as food items as well as verbs and adjectives. Eventually syntax - the other building block of language - will be added to see if the orang-utans can construct sentences to communicate with their carers.

At Milwaukee the iPads are still considered tools for entertainment rather than for research. The keepers offer them no more than twice a week, and with no food rewards it's up to the apes whether they participate.

Engel, now the zoo's official iPad enrichment coordinator, shows the orang-utans videos through the glass facing the visitors' area. They're fascinated by clips of other animals; Mahal loves videos of Humboldt penguins, though "he's not too keen on rhinos", Engel says. MJ prefers David Attenborough's BBC documentary on apes. "I think she has a crush on him," Engel adds.

The orang-utans also use free or inexpensive drawing programs such as Doodle Buddy, music app Magic Piano and simple games like Koi Pond. The animated, interactive app The Fantastic Flying Books of Mr Morris Lessmore is also a favourite. "We're collecting information on their preferences and how they use the iPads, where they position their fingers and how much of the screen they use," Khan says. She would like to commission customised apps with larger buttons and more pictures, and hopes that visitors will be able to download the same apps and use them to compete with the orang-utans in games using their own mobile gadgets.

But first she and Engel must face a challenge of their own. At the moment Milwaukee's apes must reach through their enclosure's metal bars to touch the iPad screens. "If they got a hold of it, they'd take it apart," says Khan. To solve this, keepers at the Smithsonian National Zoo mounted their computers on walls and heavy carts and added transparent plastic covers to protect the screens. Each device then needed additional sensors to measure the position of an orang-utan's fingers. So Khan and her colleagues are looking for a simpler and cheaper way to make the iPad's wafer-thin screen ape-proof. They have begun by contacting industrial designers who specialise in computer casings. Zimmerman also plans to consult dolphin expert Jack Kassewitz for his experience using waterproofed iPads (see "Appiness for all"). "Orang-utans pee on everything," says Zimmerman.

Man killed amid Britain's post-Christmas sales (AP)

LONDON ? A teenager was fatally stabbed Monday after an argument broke out in a sports store on London's most famous retail street as thousands of shoppers flocked to Britain's capital seeking post-Christmas bargains.

The killing of the 18-year-old man on Oxford Street did little to deter shoppers crowding into neighboring stores in the landmark shopping district. Bargain hunters were also largely untroubled by a subway strike which badly disrupted the city's public transport services.

Selfridges ? close to the scene of Monday's stabbing and one of Britain's most popular department stores ? reported its biggest ever first hour of trading Monday morning, while the New West End Company, which represents traders on central London's shopping streets, reported 15 million pounds (US$23.5 million) in sales in the first three hours of trading.

"As ever, the West End's Boxing Day sales have attracted shoppers in their hundreds of thousands," said Jace Tyrrell, of the New West End Company.

Sue West, Selfridges' director of operations, said that ladies' accessories and jewelry were the most popular items snapped up. "Despite Tube disruptions ... we had record sales in our first hour," West said.

London's air ambulance helicopter had earlier rushed to the street following the stabbing, but the teenage victim died before medics could administer help.

Police, who erected a tent outside a Foot Locker sports store as they carried out investigations, said ten people had been arrested in connection with the death.

Det. Chief Insp. Mark Dunne, of London's Metropolitan police, said two groups of young people appeared to have become involved in a large-scale altercation.

Dunne said little more was known about the circumstances, but there was likely to be a large number of witnesses. "This is probably the busiest place in the United Kingdom right now, on the busiest shopping day," he told reporters at the scene.

On London's subway network, the ASLEF train drivers' labor union staged a one-day strike to demand extra pay and additional time off for members working on the public holiday.

Despite the disruptions, huge crowds ? some lining up outside stores from midnight ? rushed into department stores in London and other British cities as soon as doors opened early Monday.

The London Underground, the organization that manages the subway system, condemned the move, saying it was pointless and demonstrated "a complete disregard for our customers." Authorities said extra buses were running in main shopping areas to cater to the increased flow of travelers on one of the year's busiest shopping days.

The ASLEF union has warned it plans to stage three more strikes in January and February if the dispute is not resolved.

Studios generally underestimated the size of their movie audiences over the weekend, and they're now revising the holiday revenues upward.

Leading the way is Tom Cruise's "Mission: Impossible ? Ghost Protocol," which pulled in $29.5 million for the weekend. That Monday figure is $3 million more than distributor Paramount estimated a day earlier.

For the four-day period Friday to Monday, Paramount estimates "Ghost Protocol" will have taken in $46.2 million to raise its domestic total to $78.6 million. That's on top of $140 million the film has taken in overseas, giving it a worldwide haul of $218.6 million.

Studios Monday also reported stronger results than they did a day earlier for Robert Downey Jr.'s "Sherlock Holmes: A Game of Shadows," which was No. 2 at $20.3 million for the three-day weekend and $31.8 million for the four-day period; Steven Spielberg's "The Adventures of Tintin" at No. 5 with $9.7 million over three days and $16.1 million for four days; and Matt Damon's "We Bought a Zoo" at No. 6 with $9.5 million over three days and $15.6 million for four days.

In a tight race for the No. 4 spot were David Fincher's "The Girl with the Dragon Tattoo" and the family sequel "Alvin and the Chipmunks: Chipwrecked."

A few films debuted on Christmas Day, among them Spielberg's World War I epic "War Horse," which took in $7.5 million Sunday. Through Monday, its estimated two-day total is $15 million.

Also debuting was Emile Hirsch's action thriller "The Darkest Hour," which earned $3 million Sunday and had a two-day total of $5.5 million through Monday.

Opening solidly in just six theaters was Tom Hanks and Sandra Bullock's Sept. 11 drama "Extremely Loud & Incredibly Close," which took in $71,000 Sunday and $136,000 through Monday. The film expands to nationwide release in January.

Despite the upward revision on some movies' revenues, the Christmas weekend continued a box-office slide that has persisted since Thanksgiving. Overall revenues from Friday to Monday totaled $184 million, down 10 percent from Christmas weekend last year, according to box-office tracker Hollywood.com.

North India shivers, death toll 128

North India continued to shiver under cold wave conditions as icy winds lashed the region claiming five more lives pushing the country-wide death toll this winter to 128.

Uttar Pradesh has been the most severe hit which has so far accounted for 88 fatalities.The capital, Delhi, has been badly hit by the cold snap, along with Haryana, Punjab and Uttar Pradesh.

Chilly winds swept the state as mercury plunged to a low of 0.5 degrees Celsius in Najibabad area in Bijnor district.

The national capital witnessed coldest day of the season recording a minimum temperature of 3.3 deg C, five degrees below normal.

Kashmir Valley reeled under under bone-chilling cold with most places recording below sub-zero temperatures.

Hill resort Gulmarg endured intense cold registering a low of minus 11.6 deg C, a MeT official said.

The tourist resort of Pahalgam in South Kashmir recorded a low of minus 7.4 deg C against yesterday's minus 8.2 deg C.

In remote Leh district in Ladakh region, the minimum temperature rose by nearly three degrees to settle at minus 15 deg C, he said.

In summer capital Srinagar, the minimum temperature fell by 2.1 degrees Celsius compared to yesterday to settle at minus 3.3 deg C.

Punjab and Haryana remained in the grip of a cold wave with Rohtak, the coldest place in the two states, reeling at minus 0.8 deg C.

Chilly winds blew across the Union Territory of Chandigarh which experienced the coldest day of the season with mercury plummeting to a low of 1.9 degrees Celsius.

Holy city Amritsar, Patiala and Ludhiana in Punjab recorded minimum temperatures of zero, 2.8 and 3.7 degrees respectively, the MeT office said.

Mercury dipped in Rajasthan with Churu recording the lowest temperature of the season at minus one degree Celsius,five notches below normal.

Mount Abu, the only hill station in the state, recorded a low of one deg C.

Thick fog blanketed several places in the region hitting road and rail traffic. Several trains were running behind schedule, a Railway spokesman said.

Keith Ferrazzi: Serve and Grow... Together This Holiday

A number of holiday seasons ago we were sitting at a fancy resort attending a well-known holiday weekend event that I had proudly accepted an invitation to along with almost a thousand other individuals and their families. We were talking about the state of our world when my guest leaned over and asked: "Do you think next year we might actually go do something instead of just talking about it?"

The comment launched our annual tradition of traveling to a third world country to serve in orphanages for the holidays. We wanted to "do something good" and the choice has ended up being one of the most unexpected and powerful gifts we have given ourselves.

This year, a number of friends and their families are joining us to serve others, rejuvenate themselves, explore a new region of the world, and to connect much more deeply as a family through our service to and engagement with orphans living just outside of Antigua, Guatemala.

I did this particular trip a few years ago and was struck by the amazing beauty of it all. It was a spiritually grounding experience and an empowering way to start the New Year. I can't wait to see the experience through the eyes of our friends' children. The experience is transformative to anyone who has not experienced real poverty, but then also to witness such deep joy among those with nothing. Each year we grow more connected as a family and a couple.

These experiences prove to be transformational, a reflective and stark reminder of what's important. Our hope is that we all come back more grounded, more empathetic, authentic and generous, and that it stays with us. Being able to help others in such a real way has even accelerated my own leadership when I get back home. I know my team relationships have become more understanding and our collaborative success has grown.

We also welcome and include our friends and their families who do not go with us. In supporting last year's trip, which was to Cambodia, our friend Arianna donated 20 chickens to the kids we met during one of our days at an orphanage. Oh, and also a big pot of milk and cookies, which I suspect the kids may have appreciated more than the chickens.

CULLOWHEE, N.C. (AP) -- Western Carolina has hired veteran Appalachian State assistant Mark Speir (SPEER) as its head football coach.

Western Carolina announced Thursday that Speir is taking over for Dennis Wagner, who resigned last month after going 8-36 in nearly four seasons.

Athletic director Randy Eaton calls Speir "a fit" in the athletic department, the campus and the community.

This marks Speir's first head coaching position at any level. He coached four different positions for the rival Mountaineers since 2003 and had been their recruiting coordinator since 2004. He coached inside linebackers this season.

The Kannapolis native was on Western Carolina's staff from 1991-94, coaching running backs and outside linebackers. He also coached at Presbyterian and Elon before moving to Appalachian State.

An expensive decision, no doubt, but one in keeping with a fundamental moral stance against abortion and one with which I completely agree:

?A Bible published by the Southern Baptist Convention to raise awareness and money for breast cancer has been pulled from shelves in America after Christians complained that the charity it was backing supported abortion provider Planned Parenthood. The Southern Baptist Convention?s publishing arm released its cancer awareness Bible in October ?as a way to place God?s Word into the hands of those suffering through breast cancer?, it said, with $1 from each sale going to the Susan G Komen Breast Cancer Foundation for breast health education, screening and treatment programmes. But after it discovered ?the overwhelming concern? that some of the foundation?s affiliates were donating funds to Planned Parenthood, the sexual healthcare and abortion provider, it made the decision to withdraw it.

And this is what LifeWay posted:

We made a mistake.

As part of Breast Cancer Awareness Month in October, B&H Publishing Group released to several mass market retailers a Cancer Awareness Bible as a way to place God?s Word into the hands of those suffering through breast cancer. As part of the project, B&H agreed to donate $1 from the sale of each Bible to the Susan G. Komen Breast Cancer Foundation for breast health education, screening and treatment programs.

As this project has developed, we realized it was a mistake.

When our leadership discovered the overwhelming concern that some of Komen?s affiliates were giving funds to Planned Parenthood, we began the arduous process of withdrawing this Bible from the market. Though we have assurances that Komen?s funds are used only for breast cancer screening and awareness, it is not in keeping with LifeWay?s core values to have even an indirect relationship with Planned Parenthood.

B&H?s mission to advance the gospel through distribution of God?s Word is unchanged, so we will continue to seek innovative ways that are in keeping with LifeWay?s core values.

Asus sued by toy robot maker for naming its tablet Transformer Prime (Yahoo! News)

Hasbro believes the new tablet's name is too close to Transformer Optimus Prime's

To be reminded of robots whenever the?Asus Transformer tablets are mentioned is inevitable. After all, Hasbro's line of Transformers toy bots has enjoyed tremendous popularity in recent years, thanks to Michael Bay's film trilogy. The toy company thinks that the newest Asus tablet, the?Transformer Prime, sounds a bit too much like one of its most popular robots, though. So, it decided to file a lawsuit against the computer maker in Los Angeles federal court.

We didn't hear anything from Hasbro when the first Transformer tablet was released, but it seems Asus crossed the line this time by naming its new device too close to?Optimus Prime. "Hasbro continues to aggressively protect its brands and products and the specific actions we are taking today against Asus underscores yet again Hasbro's willingness to pursue companies who misappropriate our intellectual property for their own financial gain," the company wrote in an email to?Paidcontent.

Hasbro's litigation would've usually been invalid based on current trademark law, since?tablets and toy robots do not fall under the same category. The toy company asserts, however, that the Transformers brand is expanding, and it has to protect names associated with its products. Hasbro is currently seeking damages as well as a temporary injunction on the Transformer Prime, which has just?started shipping from a few retailers this December 19.

General Mills 2Q profit falls on higher costs (AP)

NEW YORK ? General Mills' second-quarter net income slipped 28 percent in the second quarter, the company said Tuesday, citing rising costs. Revenue jumped by double digits as it was able to successfully raise prices.

The food company maintained its adjusted full-year earnings guidance, but cautioned that second-half gross margin as a percent of sales will be below year-ago levels.

General Mills, which sells Cheerios, Yoplait yogurt and other foods, has struggled as other food producers have with higher costs for nearly everything, from ingredient to packaging. Most companies have hiked prices to offset these pressures. Higher prices and strong demand boosted revenue at General Mills, but its own rising costs have tugged at profits, which fell shy of most expectations.

The Minneapolis company earned $444.8 million, or 67 cents per share, for the quarter ended Nov. 27. That's down from $613.9 million, or 92 cents per share, a year earlier.

Excluding charges tied to its Yoplait deal and other items, earnings were 76 cents per share.

Analysts polled by FactSet were looking for earnings of 79 cents per share.

The company's stock fell 14 cents to $39.45 in premarket trading.

General Mills announced in July that it was acquiring a controlling stake in Yoplait. It was the first full quarter with the yogurt brand under its ownership, boosting total international sales by more than 50 percent.

Quarterly revenue rose 14 percent to $4.62 billion from $4.07 billion, helped by higher prices. Wall Street expected revenue of $4.6 billion.

Revenue for the U.S. retail segment climbed 3 percent thanks to increased prices and strong snack sales.

Snack sales rose 20 percent, driven by Fiber One and Nature Valley snack bars, while sales for the Pillsbury division increased 9 percent on strong demand for Totino's frozen snacks and pizza, Pillsbury refrigerated baked goods, and new Pillsbury frozen breakfast items.

Sales in the segment, which includes cereals, edged up 1 percent on solid performances from Honey Nut Chex, Cinnamon Toast Crunch and well as contributions from new products such as Cinnamon Burst Cheerios and Fiber One 80 Calorie cereal.

In the international segment, revenue surged 55 percent to $1.16 billion, driven by Yoplait. Sales were strong in Europe, while Canada, Latin America and the Asia/Pacific region also posted sales gains.

Bakery and foodservice revenue rose 12 percent to $522 million in the quarter.

For the full year, General Mills still expects adjusted earnings of $2.59 to $2.61 per share. Analysts predict earnings of $2.61 per share.

The company said its second-half adjusted earnings per share will likely see a high single-digit to low double-digit percentage increase, with sales for the period rising by double-digits. Gross margin as a percentage of sales is anticipated to drop below the prior-year level due to increased costs and the business adjustments needed to include the Yoplait transaction. Operating profit in the second half is expected to rise above year-ago levels, with a planned increase in advertising and media spending.

SKorean president presses Japan on sex slaves (AP)

TOKYO ? South Korea's visiting president pressed his Japanese counterpart Sunday to resolve a long-standing grievance regarding Korean women forced to serve as sexual slaves during World War II, calling it a "stumbling block" in their relations.

Japan maintains that the matter was settled by a bilateral treaty in 1965 that normalized relations, and Prime Minister Yoshihiko Noda said he reiterated that stance during their meeting in the ancient capital of Kyoto.

Victims say they want compensation and the prosecution of wrongdoers.

President Lee Myung-bak said only 63 women who have identified themselves publicly as former wartime sex slaves are still alive, average age 86. He said 16 such women died this year.

"They could all die in a few years," Lee said, according to his spokesman Park Jeong-ha. "In such a case, (the issue) will remain a big burden the two countries cannot resolve ... We can only resolve (the issue) now."

"South Korea and Japan should become true partners for co-prosperity and regional peace and stability. For that, I think we need to have the genuine courage of resolving as a priority the issue of comfort women, which has been a stumbling block in relations between the two countries," Lee told Noda, according to a media pool report posted on the president's website.

The issue had gained renewed attention after protesters in Seoul placed a statue of a girl representing the victims in front of the Japanese Embassy on Wednesday.

The life-size statue of the girl, sitting on a chair in traditional Korean clothes, was unveiled to mark the 1,000th weekly rally for women forced to work in brothels for Japanese soldiers occupying the country. Several of the women joined the rally along with lawmakers.

Noda called the statue "regrettable" and said he asked Lee to remove it.

"Our nation's legal position on the issue of comfort women has already been settled," Noda told reporters. He added that Japan would continue to make efforts from a "humanitarian standpoint."

Lee said such a statue would have not been built if Japan came up with more sincere measures to resolve the issue, the presidential spokesman said.

Tokyo in 1995 initiated a fund of private donations as a way for Japan to pay former sex slaves without providing official compensation. But many comfort women have rejected the fund, demanding a government apology approved by parliament, along with compensation paid by the government.

Noda said the leaders also discussed speeding up the start of free trade negotiations.

Howard Stern Responds to PTC Criticism


Howard Stern has an important message for parents around the world: he has no intention of turning your children into sex fiends.

The new America's Got Talent judge issued this missive during an appearance on Piers Morgan Tonight, in response to criticism leveled at NBC for hiring the lesbian-loving radio host.

The PTC thinks "I'm some sort of weird pervert who's going to convert America into some kind of zombie sex fiends," he told the man he's replacing, adding:

"I can assure you and the rest of America what I'm looking at here is to be a very good judge. To sit there, I take it seriously, you know I watched the show."

Stern is a father who is actually quite protective of children. He even questions those who place theirs on the America's Got Talent stage.

"I raised three daughters and I don't think that that would be appropriate. But there are parents out there who think it's a good idea. And you got to be damn sure that this is a wise decision before you do it, because not only are you putting a kid out there, to be judged, but - you know, if a kid really does have talent, you do need time to nurture that talent, develop that talent."

Bargainers reach deal to head off gov't shutdown (AP)

WASHINGTON ? Congressional negotiators reached agreement Thursday on a compromise spending bill to avert a weekend federal shutdown. They also worked toward a deal renewing the payroll tax cut and unemployment benefits for another year but prepared a shorter version as a fallback.

Senate Majority Leader Harry Reid, D-Nev., told reporters he was still optimistic that bipartisan talks on yearlong extensions of the Social Security payroll tax cut and unemployment coverage would succeed. But as a "Plan B," he said, they were working on a two-month extension as well, which would also prevent cuts in Medicare reimbursements for doctors during that period.

"We're still working on the long-term" bill, Reid told reporters as he exited the Capitol after a day of talks over both the payroll tax and spending measures. As for the two-month version, he said, "We'll only do that if what we're working on doesn't work out."

Reid's remarks put a slight damper on a day on which for the first time, Democratic and Republican leaders expressed optimism at prospects for swift compromise on their payroll tax standoff and a spending battle that had threatened to shutter federal agencies beginning at midnight Friday.

A deal on a $1 trillion spending bill was reached after Republicans agreed to drop language that would have blocked President Barack Obama's liberalized rules on people who visit and send money to relatives in Cuba. But a GOP provision will stay in the bill thwarting an Obama administration rule on energy efficiency standards that critics argued would make it hard for people to purchase inexpensive incandescent light bulbs.

The House is expected to approve the spending measure Friday, and the Senate could follow suit, possibly the same day.

Donald Stewart, spokesman for Senate Minority Leader Mitch McConnell, R-Ky., said talks aimed at agreeing to a yearlong extension of the payroll tax measure will continue.

"We're 12 hours into this debate, they just started talking," he said when asked about the two-month version of the bill. "I wouldn't hit the panic button."

A senior White House official said the administration supported the two-month plan.

Bargainers were considering the two-month extension of this year's payroll tax cut and unemployment benefits bill because so far, they haven't agreed how a yearlong extension would be paid for, said a Democratic aide who spoke on condition of anonymity to discuss the private talks.

The two-month bill would cost $40 billion, according to the aide. It would be paid for from a list of around $120 billion in savings that bargainers are considering, including sales of the broadcast spectrum and raising fees that Fannie Mae and Freddie Mac charge to back mortgages, the aide said.

The two-month extension would let lawmakers revisit the measure after returning to Washington after the holiday season. That could be risky because that work would come well into the 2012 presidential and congressional election year.

Without congressional action, the payroll taxes would rise and extra benefits for the long-term unemployed would expire on Jan. 1. Doctors' Medicare payments would be automatically reduced that day by 27 percent, a reduction that could prompt some to stop seeing Medicare patients.

"Right now, Congress needs to make sure that 160 million working Americans don't see their taxes go up on Jan. 1," said Obama, referring to the tax cut extension at the core of the jobs program he outlined in a nationally televised speech three months ago.

House Speaker John Boehner of Ohio, the most powerful Republican in an era of divided government, agreed. "We can extend payroll tax relief for American workers, help create new jobs and keep the government running. And frankly, we can do it in a bipartisan way," he said.

In the Capitol, the previous day's bristling rhetoric and partisan jabs all but vanished.

Still another year-end bill, setting new rules for the handling of terror suspects in U.S. custody, won final congressional approval and headed to Obama's desk for his signature.

Republicans agreed to consider changes to a $1 trillion spending bill compromise that they and at least one Democrat said had been wrapped up days ago.

On the payroll tax cut bill, Democrats abandoned their demand for a surtax on million-dollar incomes that they wanted to include in the measure.

At a news conference, Boehner minimized the concession, noting that Democrats lacked the votes to impose the surtax a year ago when they commanded 60 votes in the Senate. Even so, he said, "there was some movement yesterday from the White House and Democrat leaders" toward a compromise.

Boehner also left open the possibility of a compromise on another key sticking point ? a House-passed provision that all but requires construction of the proposed Keystone XL oil pipeline from Canada to Texas Gulf Coast refineries.

Construction "will put 20,000 people to work immediately And there are about 115,000 other jobs directly related to it," he said. Yet he skipped an opportunity to say construction of the project was non-negotiable as talks on the payroll tax cut bill proceeded.

Obama has threatened to veto the House-passed bill, in part citing the requirement for the pipeline. The project has been studied for more than three years, but the president recently announced he would put off a decision until after the 2012 elections.

At Obama's insistence, Congress cut the 6.2 percent Social Security payroll tax to 4.2 percent this year in an effort to stimulate the economy with more consumer spending. The president has proposed deepening the cut to 3.1 percent next year, but Republicans have only shown a willingness to renew it at this year's level.

Obama also wants to leave in place a system that provides aid for up to 99 weeks for the long-term unemployed. The House-passed measure reduces the total by 20 weeks, a step that the administration says would cut off 3.3 million individuals and that Democrats are hoping to soften if not reverse.

Reid indicated that a number of expiring tax breaks were on the table, as well, a list that included a provision that benefits commuters who use mass transit.

The House-passed payroll tax cut measure relied on a pay freeze and increased pension contributions for federal workers, as well as higher Medicare premiums for seniors with incomes over $80,000, beginning in 2017. The bill would also raise a fee that is charged to banks whose mortgages are guaranteed by Fannie Mae and Freddie Mac and cancel more than $40 billion from the year-old health care bill, Obama's signature domestic achievement.

The year-end, $1 trillion spending measure would lock in cuts that Republicans extracted from Democrats in negotiations conducted months ago against the deadline of a previous government shutdown threat. It funds 10 Cabinet departments, including the Pentagon and dozens of smaller agencies, awarding a slight increase to the military and veterans' programs while trimming most other domestic programs.

The separate defense bill covered military personnel, weapons systems, the wars in Afghanistan and Iraq and more at a cost of $662 billion, $27 billion below Obama's request. The Senate approved it by a resounding 86-13.

The main controversy revolved around a provision to require military custody for foreign terrorist suspects linked to al-Qaida or its affiliates and involved in plotting or attacking the United States. Under a change made to gain Obama's backing, the legislation would permit the FBI to arrest and interrogate foreign terror suspects, as is now the case.

AP Sources: Dem lawmakers may drop millionaire tax (AP)

WASHINGTON ? Officials say Democratic lawmakers are considering whether to jettison their demand for a surtax on millionaires as a way of covering the cost of a Social Security payroll tax cut extension.

These officials stress that no decisions have been made. If party leaders go ahead, it would mark a concession to Republicans in the year-end standoff over the tax cut extension that President Barack Obama requested and leaders in both parties say they want.

The officials declined to be identified by name because they were discussing legislative strategy.

The disclosure came as Senate Majority Leader Harry Reid and other leading Democrats went to the White House to meet with Obama.

The subject of the meeting was not announced.

A grandson of the late screen actress Rita Hayworth has been found dead in an apparent suicide in New York City.

Police say 25-year-old Andrew Embiricos was discovered in his Manhattan apartment Sunday night with a bag over his head. He was pronounced dead at the scene. No crime is suspected.

A spokeswoman for the medical examiner's office says the cause of his death is pending autopsy results.

Embiricos was the son of Hayworth's daughter Yasmin Aga Khan, a philanthropist known for publicizing the plight of those suffering from Alzheimer's disease.

Hayworth was a legendary beauty who rose to fame in the 1940s and '50s in movies such as "Cover Girl" and "Gilda." She died in 1987 of Alzheimer's disease at age 68.

The Sad Fliers' Crusade for Airplane Mode (The Atlantic Wire)

After last week's New York Times column?on the pointlessess of making fliers turns off gadgets during take-off and landing, angry technophiles have?started a White House petition to get the rules changed. After two full days and a tweet from The New York Times's Nick Bilton's to his 88,879 followers, the petition only has 364 signatures.

When Bilton wrote his takedown last week, it wasn't all that convincing. In the days following his post, a few bloggers piped up to agree with Bilton, but even The Atlantic's own national correspondent and pilot, James Fallows, who?admitted "the rule is pure theater," pointed out that Bilton doesn't really have a case. "[H]ere is the only, admittedly weak rationale behind the 'turn all equipment off' diktat," Fallows wrote. "If anything went wrong on a crowded airline flight, the flight crew would need everyone's full attention, now." And for that, he will keep his iPad off at the flight attendant's?request.

Fallows isn't alone. A slew of commenters on Bilton's follow-up blog post note the inanity of the entire request. Some?pointed?out that interference can actually occur. Others suggested that a few minutes without iPad access is really a ridiculous thing to complain about. And as The Wire's Adam Clark Estes noted, one can never be too certain when an iPhone might?explode.?

Tiny church in NYC awaiting Supreme Court decision (AP)

NEW YORK ? A Christian congregation with just 48 members and not even a storefront is hoping the Supreme Court will overturn a ruling that says holding its Sunday service in a Bronx public school is unconstitutional.

At issue is a New York City Board of Education policy that allows community groups, including religious ones, to use its buildings, but specifically excludes worship services.

A divided federal appeals court upheld the policy in June, reversing a district judge. The Supreme Court is considering whether to review the case and could decide that on Monday. If it grants review, its eventual opinion could be a landmark decision, the church's lawyer says.

Robert Hall, co-pastor of the evangelical Bronx Household of Faith, said last week that his little group never expected to get involved in a big-time court case that has now lasted 17 years.

"I can assure you this wasn't strategic planning on our part," the 68-year-old Minnesota native said. "Basically we just outgrew the place we were meeting," a Christian halfway house for men.

In 1994, church leaders looked at the nearby public school in its University Heights neighborhood, applied for a permit to hold its worship service there, and were denied.

That began a legal wrangle that reached the 2nd U.S. Circuit Court of Appeals four times as Supreme Court decisions came down and the law evolved.

An early key moment came in 1995 when Hall, who has been with the church for 39 years, heard Alliance Defense Fund staff attorney Jordan Lorence on the radio, discussing barriers to religious rights.

"He called me up and said, `We're facing that issue right here,'" Lorence said.

Enter the ADF, a conservative group that says it champions "the legal defense of religious freedom, the sanctity of life, marriage and the family." It has been on the case since and is bearing the costs. Lorence is the lead attorney.

"We took the case to defend the First Amendment principle of equal access," Lorence said. "This is private religious speech and we're requesting equal access to meet in the buildings the way New York City allows all other community groups to meet."

In 2002, during a time when the city was enjoined from enforcing its policy, the Household of Faith began using Public School 15, and it has been there ever since.

In its most recent ruling, in June, the 2nd U.S. Circuit Court of Appeals noted that the while city policy excludes religious worship from its buildings, it does not exclude "prayer, singing hymns, religious instruction, expression of religious devotion, or the discussion of issues from a religious point of view."

The court found the distinction reasonable, saying that when worship services are held in a school, "The place has, at least for a time, become the church."

The court said the distinction accommodated a 2001 Supreme Court decision allowing a Christian organization to use public school facilities. It also was a reasonable way for the city to avoid violating the Constitution's prohibition on government favoring any religion, the court said.

The Board of Education praised the ruling, saying it was "concerned about having any school in this diverse city identified with one particular religious belief or practice." However, it is allowing the 60 or so congregations that now hold services in schools to continue, pending Supreme Court action.

Lorence said the distinction between religious expression and worship is arbitrary.

"You can have singing and prayer and Bible study, with all the elements of what people traditionally understand a worship service to be, but you can't have a worship service?" he said.

He theorized that a group could hold a worship service and not call it that, "and the school district will need a theologian to figure out whether the group is conducting a worship service or not."

Hall said the Household of Faith's service lasts 90 minutes or more and includes Scripture readings, hymns, communion with grape juice and bread, preaching and "spontaneous prayer" from the congregation.

Lorence said he found "bizarre" the concept that the auditorium at Public School 15 becomes a church if worship is conducted there.

"When a labor union meets there, it doesn't turn into a labor hall," he said. "When Alcoholics Anonymous meets there, it doesn't turn into the Betty Ford Clinic."

But Donna Lieberman, executive director of the New York Civil Liberties Union, said, "When a church sets up shop in a public school in a manner that conveys the appearance that the church is part of, or officially favored by, the school, it seems to run afoul of the separation of church and state."

Lorence predicted the Supreme Court would grant review and reverse the 2nd Circuit. But if not, he said, "It's over for the Bronx Household of Faith" because he can no longer go back to the 2nd Circuit.

"We're at high noon here," he said.

Pastor Hall said the church isn't worried. Though the church office is Hall's home, and some of their meetings are held in backyards, they are raising funds to complete construction of a building across from P.S. 15 that would handle all their needs, including youth ministry and worship services.

"Nobody's getting angry, there's no bad-mouthing the Board of Ed," he said. "We're kind of rolling with the punches and trusting in the Lord that he will work things out according to his good wisdom."
